General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
Consumer: The natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Day: Calendar day.
Long-term transaction: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
Durable data carrier: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance (Movae London).
Distance contract: A contract concluded within the framework of an organized system for distance selling of products and/or services, whereby up to and including the conclusion of the contract exclusive use is made of one or more means of distance communication.
Means of distance communication: A method that can be used for concluding a contract without the consumer and entrepreneur being physically present in the same place at the same time.
General Terms and Conditions: These General Terms and Conditions of the entrepreneur (Movae London).
Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the contract within a cooling-off period of 30 days without giving any reason. During the cooling-off period, the consumer shall handle the product and packaging with care.
If the consumer makes use of their right of withdrawal, they shall return the product with all delivered accessories and, if reasonably possible, in its original condition, in accordance with the reasonable instructions of the entrepreneur.
Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the entrepreneur and will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions may, by way of derogation, be made available electronically in such a way that the consumer can easily store them on a durable data carrier.
If in addition to these general terms and conditions specific product or service conditions apply, the consumer may always rely on the applicable provision that is most favourable to them in case of conflicting conditions.
If one or more provisions in these terms are invalid or void, the agreement and these terms shall remain in force and the invalid provision shall be replaced by a provision that most closely matches the original intent.
Situations not covered in these terms shall be assessed “in the spirit” of these terms.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated. The offer is without obligation.
The offer contains a complete and accurate description of the products and/or services offered. Obvious errors or mistakes do not bind the entrepreneur.
Images are a truthful representation of the products, but colours may vary.
Each offer contains sufficient information so that it is clear to the consumer what rights and obligations are attached to acceptance of the offer, including delivery costs, payment methods, withdrawal rights, and contract details.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions.
The entrepreneur confirms acceptance electronically.
The entrepreneur may refuse an order if there are valid reasons (e.g. payment risk).
The entrepreneur will provide required information regarding complaints, withdrawal, guarantees, and contract details.
All agreements are subject to sufficient product availability.
Article 6 – Right of Withdrawal
The consumer may withdraw from the agreement within 30 days without giving any reason.
The withdrawal period starts the day after the product is received.
The product must be returned in original condition and packaging where reasonably possible.
The consumer must notify the entrepreneur within 30 days and return the product within 30 days thereafter.
Article 7 – Costs in Case of Withdrawal
Return costs are borne by the consumer unless otherwise stated.
Refunds will be made within 30 days after withdrawal, provided the product has been received or proof of return is provided.
Article 8 – Exclusion of Withdrawal Rights
Certain products may be excluded from withdrawal rights, including personalised items, hygiene products with broken seals, or perishable goods.
Article 9 – Price
Prices will not increase during the validity period except for VAT changes.
Errors in pricing do not bind the entrepreneur.
Article 10 – Conformity and Warranty
Products must match the agreement and legal requirements.
Warranty does not affect statutory rights.
Defects must be reported within 30 days.
Article 11 – Delivery and Performance
Orders will be delivered within 30 days unless otherwise agreed.
Delays give the consumer the right to cancel.
Risk transfers upon delivery.
Article 12 – Duration Transactions
Rules regarding termination and renewal of long-term contracts.
Article 13 – Payment
Payments must be made within 7 days unless otherwise agreed.
Late payment may result in additional costs.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days.
Response within 14 days.
Article 15 – Disputes
Dutch law applies to all agreements, even if the consumer lives abroad.
